1. Acceptance of Terms

By clicking “Buy Now,” “Start Membership,” or otherwise purchasing access to The SoloBand Advantage (“Website,” “we,” “us,” or “our”), you (“Member,” “you”) agree to be bound by these Terms and Conditions. If you do not agree, do not purchase or use the Website.

2. Membership Types & Fees

All prices are in USD. Stripe processes all payments. We do not store or handle your credit card information.

3. No Refund Policy

All sales are final. Because all content (videos, MIDI files, tutorials, and licensed materials) is digital and non-returnable, we do not offer refunds, partial refunds, or credits for unused time. This applies to both the monthly membership and any download premium package. Exceptions are only made if required by applicable Canadian law (British Columbia’s Business Practices and Consumer Protection Act generally exempts digital goods from cooling-off periods).

4. Account & Access

  • You do not create a separate user account. Your access is tied to your email address and payment confirmation.
  • Monthly membership remains active for 30 days from purchase. If the next monthly fee is not paid, access expires immediately at month end with no grace period.
  • Download product buyers retain permanent access to purchased materials, even if monthly membership lapses. However, you may not share, sell, or redistribute any files.

5. Content Ownership & License

  • Our original content: All videos, MIDI files, tutorials, and written materials created by Ronald Lemire are protected by copyright. You receive a limited, non-exclusive, non-transferable license to use them for personal guitar learning only.
  • MIDI backing tracks: Membership-purchased, SoloBand downloadable MIDI files are exclusively licensed by SoloBand for both private and public use as a performance tool for local musicians.
  • Licensed third-party videos: We pay for the right to display certain music videos on the Website. You may not download, screen-record, share, or publicly perform them.
  • Prohibited acts: No reproduction, redistribution, resale, or public display of any content without prior written permission.

6. Prohibited Conduct

You agree not to:

  • Share your login credentials or email access with anyone else.

  • Download (except authorized files), screen-capture, or scrape any video or audio content.

  • Use the content for commercial purposes (e.g., teaching paying students with our materials).

  • Reverse engineer, copy, or create derivative works from our MIDI files or tutorials.

7. Termination & Suspension

We may suspend or terminate your access immediately, without refund, if you violate these Terms. Upon termination, you must delete all downloaded files from any digital download package.
We also reserve the right to close inactive or unpaid accounts.

8. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages (e.g., lost income, guitar injury, dissatisfaction with learning progress).

  • Our total liability to you shall not exceed the amount you paid in the previous 6 months.

  • Guitar playing involves physical activity. You assume all risk of injury.

9. No Guarantee of Results

We provide educational information only. We do not guarantee that you will become a better guitarist, earn money as a musician, or achieve any specific outcome.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any dispute shall be resolved exclusively in the courts of British Columbia. You waive the right to a class action.

11. Changes to These Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance. For material changes, we will notify you by email.

We do not keep individual purchase records beyond monthly customer count totals (used to pay for licensed video rights). We do not use analytics tools, tracking cookies, or advertising pixels.

  • To provide membership access and deliver downloadable files (via email or direct download).

  • To communicate with you about your account, payment reminders, or policy changes.

  • To detect and prevent fraud or unauthorized access.

4. How We Share Your Information

We do not sell, trade, or rent your personal information to anyone. The only third party involved is Stripe (payment processor). Stripe’s own privacy policy applies to your payment data. We do not share your name or email with any other service (no email marketing platforms, no analytics, no affiliates).

5. Data Retention & Deletion

  • Active members: Your name and email remain in our database.

  • Account closure: (non-payment or manual cancellation): Your name, email, and any associated logs are deleted.

  • Monthly totals only: We retain only the number of paying customers per month (e.g., “May 2026: 12 members”) for accounting and licensing payments. No individual data is kept.

6. Cookies & Tracking

We use essential cookies only (e.g., to keep you logged in during your session). Because these are strictly necessary for website function, no consent is required under Canadian law. We do not use tracking cookies, analytics cookies, or advertising cookies.

7. Your Rights (PIPEDA/PIPA)

As a Canadian resident, you have the right to:

  • Cancel your account (which will result in account closure and data deletion)

  • Lodge a complaint with the Privacy Commissioner of Canada or BC’s OIPC

8. Children’s Privacy

Our Website is for guitar players of all ages. If you are under 18, you confirm you have parental or guardian permission to purchase a membership. We do not knowingly collect personal information from children under 13 without verifiable parental consent. If we learn a child under 13 has provided us with personal information, we will delete it immediately.

9. Data Security

We use reasonable administrative and technical safeguards (SSL encryption, limited database access). However, no internet transmission is 100% secure.

10. Changes to This Privacy Policy

We will notify you by email of any material changes. Minor updates will be posted here with a new “Last Updated” date.
